2The Platform & Our Role

FitShare provides a technology platform that allows users to list clothing items and connect with friends to arrange borrowing. We are a platform provider only — we are not a party to any borrowing agreement between users.

We do not:

• Vet, inspect, or verify the condition of any clothing item listed
• Guarantee the accuracy of item descriptions or photos
• Facilitate the physical transfer of items
• Mediate disputes between users
• Provide insurance or compensation for lost, stolen, or damaged items

3Borrowing — At Your Own Risk

By requesting to borrow an item, you acknowledge and agree that:

• You are solely responsible for the safe return of the item in the same condition you received it
• You will return the item by the agreed return date
• If an item is lost or damaged, you accept personal liability to the owner
• FitShare will not intervene in or resolve disputes between users
• You will not use borrowed items for commercial purposes

4Lender Responsibilities

As a lender, you agree to:

• Only list items you own and have the right to lend
• Ensure items are clean and in the condition described
• Not hold FitShare liable if a borrower fails to return or damages your item
• Handle all disputes directly with borrowers
• Not list counterfeit, hazardous, or illegally obtained items

FitShare strongly recommends only lending items to people you know and trust personally. We do not recommend lending high-value or irreplaceable items.

5Affiliate Links & AI Features

FitShare uses AI to identify clothing items and display affiliate shopping links ("Shop Similar"). These links may earn FitShare a commission if you make a purchase. Affiliate links are clearly labelled with an "AI" badge.

We do not guarantee the accuracy of AI-generated item identification or the relevance of affiliate suggestions. Affiliate links direct to third-party websites and FitShare accepts no responsibility for those websites' content, accuracy, pricing, or availability.

6User Conduct

You agree not to use FitShare to:

• Harass, threaten, or intimidate other users
• List stolen, counterfeit, or prohibited items
• Post false, misleading, or fraudulent listings
• Attempt to defraud other users
• Circumvent any platform safety features

We reserve the right to suspend or terminate any account that violates these rules, at our sole discretion, without prior notice.

7Privacy & Data

By using FitShare you agree to our Privacy Policy. We collect and process personal data including your name, email, profile information, and activity on the platform to provide the service. We do not sell your personal data to third parties.

Item photos you upload may be processed by AI systems (including Anthropic's Claude API) for identification purposes. Photos are stored securely and are only visible to your confirmed friends on the platform.

8Limitation of Liability

To the maximum extent permitted by applicable law, FitShare and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of property, loss of profits, loss of data, or any other losses arising from your use of the platform or any borrowing arrangement made through it.

Our total aggregate liability to you shall not exceed £50 (fifty pounds sterling) in any twelve-month period.

9Changes to Terms

We may update these Terms at any time. We will notify you via the app when significant changes are made. Continued use of FitShare after changes are posted constitutes your acceptance of the updated Terms.

10Governing Law

These Terms are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
